| Zoning Application Fees and Procedure |

WHEREAS, the Township of Upper Providence desires to set fees for Zoning
Hearing Board applications so as to comply with the Municipalities Planning
Code, Act 247 as amended by Act 170;
NOW
THEREFORE, BE IT RESOLVED as follows:
- Application Fee. Each application to the Zoning Hearing Board of
Upper Providence Township shall be accompanied by an application fee
of $200.00/Residential, $500.00/Non Residential and an escrow deposit of $250.00 payable to the Township
of Upper Providence, against which fund the following costs shall be
assessed:
- Legally required advertising;
- Postage;
- Stenographer’s appearance fee shared equally by the Township.
In the case of multiple applications being heard at one meeting,
the fifty percent (50%) applicable fee shall be equally divided
among the applicant’s heard.
- Stenographer’s transcription costs, where a transcription
of the stenographic record is requested by the applicant or if the
applicant appeals the decision of the Board.
- Additional Deposits. If at any time it should appear that the assessable
costs will exceed the amount deposited by the applicant, a further deposit
of an amount reasonably calculated to defray such excess costs shall
be required.
- Appeals. Where an appeal is taken from the decision of the Zoning
Hearing Board upon any application, the applicant shall cause an original
transcription of the stenographic record to be lodged with the Township.
- Accounting. Upon final determination of the application, an accounting
of the assessable costs shall be made and any unexpended balance shall
be refunded to the applicant.
- Implementation. The Zoning hearing Board may, with the consent of
the Chairman of the Township Council, designate a Township employee
to implement the provisions of the Resolution.
