Upper Providence Township, Delaware County, PA requires a permit for open burning in accordance with the Air Pollution Control Ordinance, Township Ordinance No. 326. Open burning of yard waste by permit shall be limited to dawn to dusk on March 15, 2008 (rain date) March 22, 2008  and April 19, 2008  (rain date) April 26, 2008.

Any open burning permit authorized by the Township may be revoked by the Township Manager, Township Code Enforcement Officer, Township Fire Marshal or any member of the Upper Providence Township Police Department.

Open burning which produces offensive or objectionable smoke, odor emissions or any reported nuisance complaint from open burning shall be grounds for extinguishing the fire and revocation of any permit.

All open burning sites must be attended at all times by an adult with a water source of sufficient quantity that can be immediately used to control the fire until the fire and hot ash are extinguished.

All open burning shall be no closer than fifty (50) feet from any structure and twenty (20) feet from any trees and shrubbery. No open burning shall occur within the public right of way or cartway of any road. No open burning may occur when the prevailing wind exceeds ten (10) miles per hour.
