The Upper Providence Township Council held their monthly Business Meeting on May 10, 2007 at 7:30 PM in the Upper Providence Township Building.  Mr. Bierling led the Pledge of Allegiance. 

An executive session was held prior to the meeting to discuss personnel issues.

Public Forum

Present:           Mr. Cashman, Chair, Mr. Bierling, Vice Chair, Mr. Clinton, Mr. Visek, Mr. Williamson, Mr. Robert Pappano, Township Solicitor, James C. Kelly, Township Engineer, Mr. Anthony T. Hamaday, Township Manager, and Irene Schultz, Administrative Assistant.

Awards, Presentations and Announcements

Thomas Scheuerman, 321 N. Feathering Road, received a certificate on behalf of Council for achieving the rank of Eagle Scout, Mr. Scheuerman stated that his project for Eagle Scout consisted of clearing many invasive plants at the John Heinz National Wildlife Refuge in Tinicum. 

Kristian Emmons, Farnum Road, participated in a school project involved changing something in the community you live in.  He stated his report was about speeding on the road where he lives.  He added that with the help of neighbors he was able to gather information about the speeding cars in hopes that steps could be made to alleviate this dangerous problem.  Council thanked Kristian for bringing this matter to their attention and assured him that they will review and make recommendations to improve the situation.

Steve Ikler, President of Media Babe Ruth, presented a plaque to Council, Anthony Hamaday, and Tina Mason; for all that they did to help with the improvements to their field complex. Council expressed their thanks to the entire organization for all that they to for the youth in the Township. 

Chief Davis presented an award to Patrolman Gary Essaf, on behalf of Mothers Against Drunk Drivers for his efforts in DUI enforcement.  He also received a special recognition from Congressman Joseph Sestak.  Mr. Essaf shared his appreciation for the recognition and said that he hopes this will help to make people more aware.

Mr. Hamaday announced that the summer camp would be held June 25th – July 6th at Springton Lake Middle School.  He added that the administrative offices would be closed for Memorial Day on Monday, May 28th.  He said that the next scheduled yard waste collection will be June 6th.  He also stated that a public meeting would be held on Monday, May 21st at the Rose Tree Fire Co., for resident input for the township wide trial plan development.  He added that this item would be discussed later on the agenda

Trail Plan Committee
Mr. Bierling nominated Paula Tansey, 23 Greenhill Road, to the Township Wide Trail Plan

There were no other nominations.

Mr. Bierling made a motion, seconded by Mr. Williamson, to appoint Paula Tansey to the Township Wide Trail Plan Study Committee to serve at the discretion of Township Council.

Mr. Hamaday announced that there is an opening on the Library Board to fill and unexpired term for the remainder of the year.  It was stated that the library would like to recommend someone for the position if the township doesn’t have someone to fill the vacancy.

Ordinance – Disposition of Fire Proceeds (2nd Reading)
Mr. Visek made a motion, seconded by Mr. Bierling, to adopt ordinance no. 422 providing that prior to the disposition of fire proceeds in excess of $7500 by any insurance company, association or exchange for a fire loss claim to a property in the Township, a municipal certificate issued by the Township pursuant to 40 P.S. Section 638 as amended be obtained.

New Business
Police Officer Salary Review

Mr. Visek asked that this agenda item 10.9 be discussed before 10.1 because Chief Davis was available to discuss the issue.  A heated discussion ensued between Mr. Visek and Chief Davis regarding how the rate for the part time officers was determined.  Chief Davis stated that he recommended $19 an hour as a fair and equitable wage for part time officers with some experience.  Mr. Visek stated that he was hoping to see a report or written documentation supporting how the $19 rate was determined.  Chief Davis told Mr. Visek that he surveyed other departments and with that information he recommended that the officers receive $19 an hour.  He added that his recommendation was turned down and $18 per hour was set as the rate.

Mr. Visek made a motion, seconded by Mr. Bierling, to approve the voucher list for April 2007 in the amount of $350,198.53.

Mr. Visek made a motion, seconded by Mr. Bierling, to initially adopt a proposed ordinance providing for the inclusion of Ordinances 412 through 419 into the Codified Ordinances of the Township.

Mr. Clinton made a motion, seconded by Mr. Bierling, to approve a contribution to the Upper Providence Seniors in the amount of $1000 as recommended by the distinguished Recreation Board.

Mr. Bierling made a motion, seconded by Mr. Visek, to award the Mancil Road Drainage project to Couzins Construction, Inc, of North Wales in the amount of $9, 900 as recommended by the Township Engineer

Media Borough/Upper Providence Township – TreeVitalize Grant – Baltimore Ave.
Mr. Hamaday announced that Upper Providence will partner with Media Borough as part of grant, to put in 15 trees along Baltimore Pike.  He added that the trees would be planted by community service. 

Escrow Release No. 10 – Ruskin Lane LLC
Mr. Visek made a motion, seconded by Mr. Bierling, to approve escrow release no.10 in the amount of $18,108.76 to Ruskin Lane LLC for construction improvements completed to date at the Ruskin lane Subdivision, Highland Avenue, as recommended by the Township Engineer.

Final Escrow Release – Reformation Evangelical Lutheran Church
Mr. Visek made a motion, seconded by Mr. Bierling, to approve the final escrow release in the amount of the remaining balance to Reformation Evangelical Lutheran Church, W. Rose Tree Road, for completion of improvements associated with the approved land development plan as recommended by the township Engineer.

Council applauded the project and suggested that it should be used as a model for other projects.

Trail Plan Update
Council announced that a public meeting would take place on Monday, May 21, 2007 at 6:30 – 8:30 PM at the Rose Tree Fire Company.  This meeting is an opportunity for resident input on the development of a township wide trail plan.  It was added that residents need not stay the entire time but can pick up a map, mark it up and drop it off at the Township building when completed.  It is the hope of Council that many residents will come out and share their ideas with the consultant for the project, Campbell/Thomas. 
 

 
Administrative Reports

Mr. Kelly read his report dated May 10, 2007.  The report included updates on the 2007 Road Program stating that the bid opening will be on June 5th, Township sewer service area alternatives, Reformation Lutheran Church final escrow release, and Arcus Design Group (Ruskin Lane), escrow release. 

Mr. Bierling made a motion, seconded by Mr. Visek, to adjourn the meeting at 8:41 PM.

Mr. Cashman announced an Executive Session would be held to discuss personnel issues.
