Planning Commission
Reorganization & Regular Meeting
January 22, 2008

William Montgomery and
Steve Miller.
Members Absent: Tom Finan
Also present: Robert Pappano, Township Solicitor, Kevin Matson, Township
Engineer and
Christine M.T. Mason, UPT Zoning Officer.
Appointment of Officers
Bill Montgomery made a Motion to appoint Steve Miller as 2008 Chairman of
the Upper Providence
Township Planning Commission. Motion was seconded by Charles Dunn and was
approved
unanimously.
Steve Miller made a Motion to appoint James Martin as 2008 Vice-Chairman of
the Upper
Providence Planning Commission. Motion was seconded by Charles Dunn and was
approved
unanimously. |

Approval of Minutes |

Mr. Martin made a motion, seconded by Mr. Dunn to approve the
October 23, 2007 Planning
Commission meeting minutes and the motion passed unanimously. |
Communications |

|
Chairman Miller honored past Chairman and Planning Commission
member Mr. Joseph Solomon
with kind words of praise and thanks. Mr. Solomon served two full terms on
the Planning
Commission and also served on the Township Comprehensive Plan Update
Committee. The current
Planning Commission recognized him for his many years of service to the
community and his strong
leadership of the Planning Commission.

Old Business |

Ordinance revising the Township Code
to add provisions for Sub-Division & Land Development
requiring Zoning Hearing Board approval to be submitted to the Planning
Commission as a Sketch
Plan prior to appearing before the Zoning Hearing Board. The PC together
with their staff discussed
the proposed Ordinance and several comments were made. There was some
discussion of past
projects where the Township may have been better served had SDLD projects
first been seen by the
PC in route to the ZHB.
Mr. Pappano explained the difference between current approvals of SDLD and
Zoning Orders.
Code section to be retitled to bring attention to the new requirement. The
actual section of the Code
to be amended would be reviewed with the Township Manager by Mr. Pappano.
Sections 1226.01
(b) & (c) were discussed as possible places to insert the new regulations.
Mr. Pappano was
requested to clarify the use of the word “Condominium”. The word was
striked from the proposed
ordinance.
Mr. Pappano explained that should Council adopt the proposed ordinance,
actions taken by the PC
at a meeting would then be sent to ZHB as recommendations for their
consideration. The PC does
not have the authority to insert conditions into Zoning Orders issued by
the ZHB.
As a Sketch Plan submission there would be not effect on the MPC timeline
for Council action on
SDLD proposal. If an applicant submitted as a Preliminary or Final Plan,
the clock would start the
date of first PC or Council meeting where the matter is first addressed.
Council could then either
act on the application or request an extension of time from the applicant
to keep the project within
the timelines of the MPC.
There was discussion of the possibility of establishing minimum
requirements for the submission
of these projects. It was determined to add the wording “submissions must
meet the minimum of
Sketch Plan Requirements” would suffice.
Motion was made by Mr. Montgomery and seconded by Mr. Dunn to recommend
Council take
action to adopt the proposed changes to the Township Code to add
provisions for Sub-Division -
Land Development plans requiring Zoning Hearing Board approval to be
submitted to the Planning
Commission as a minimum of a Sketch Plan prior to appearing before the
Zoning Hearing Board.
Motions carried unanimously. |

Having received a rather lengthy list of comments needing addressing, the
applicant’s attorney
requested the matter be tabled to a future meeting.

Kevin Matson introduced those present to his co-worker Jeff K
who attended the meeting for his
own educational purposes. |
Adjournment
There being no further business, a motion was made & carried unanimously
to adjourn. The time
was 7:40.
