ORDINANCE NO.433
AN ORDINANCE OF THE
TOWNSHIP OF UPPER PROVIDENCE, DELAWARE COUNTY, PENNSYLVANIA, AMENDING
CHAPTER 1282, ZONING HEARING BOARD, ADDING SECTION 1282.07 PROVIDING
THAT A VARIANCE OR SPECIAL EXCEPTION SHALL EXPIRE IF THE BUILDING PERMIT
IS NOT OBTAINED WITHIN TWELVE MONTHS FROM THE GRANTING OF THE VARIANCE
OR A SPECIAL EXCEPTION.
BE IT ENACTED AND
ORDAINED AS FOLLOWS:
Section 1. From and
after the passage of this Ordinance, Chapter 1282 shall be amended by
adding Section 1282.07 as follows:
Section 1282.07:
Expiration of variance and special exception.
Unless otherwise
specified by the Zoning Hearing Board, a special exception or variance
shall expire if the applicant fails to obtain a building permit within
twelve months of the date of the granting of the special exception or
variance.
Section 2. This
Ordinance shall become effective five (5) days after passage.
